Welcome to Surfing4all, https://surfing4all.com. By accessing our website, booking surf lessons, or purchasing services for our locations in Rio de Janeiro, Brazil and/or San Diego, California (USA), you agree to comply with and be bound by these Terms and Conditions.

1. Scope of Services / Escopo dos Serviços

[Company Name] provides surf instruction, group and private lessons, equipment rentals, and surf experiences operating in two primary regions:

Rio de Janeiro, Brazil: (e.g., Arpoador, Barra da Tijuca, Recreio/Macumba, Leme).

San Diego, California, USA: (e.g., La Jolla Shores, Pacific Beach, Ocean Beach, Coronado).

2. Health, Swimming Ability & Safety Requirements

Surfing is a physically demanding activity taking place in open ocean environments. By booking a lesson at any location, the Client declares and warrants that:

They are in good physical and mental health and possess basic open-water swimming skills.

They will inform instructors prior to the lesson of any pre-existing medical conditions (e.g., heart issues, injuries, pregnancy, asthma).

They strictly agree to follow all safety directions given by certified instructors on land and in the water.

3. Payments, Pricing & Currency

Currency: Prices are displayed in USD ($) for San Diego bookings and BRL (R$) or USD ($) for Rio de Janeiro bookings, as specified during checkout.

Confirmation: Bookings are only confirmed upon successful payment processing via our online payment gateways.

4. Cancellation, Weather & Rescheduling Policy

Client Cancellations:

Standard Cancellation: Cancellations made at least [e.g., 48 hours] prior to the scheduled lesson time receive a full refund.

Late Cancellation / No-Show: Cancellations made within [e.g., 24 hours] of the lesson, or failure to show up (no-show), are non-refundable.

Weather & Ocean Conditions (Force Majeure):

Ocean conditions dictate surf safety. Lessons may be canceled or rescheduled by our staff due to hazardous ocean conditions, including:

San Diego: High surf advisories, heavy pollution run-offs after storms, or dangerous rip currents.

Rio de Janeiro: Severe storms, dangerous undertows/correntes, or ocean contamination flags (imprópria para banho).

Note: If a lesson is canceled by [Company Name] due to safety or weather concerns, clients will receive a free reschedule or a 100% full refund if rescheduling is not possible.

5. Assumption of Risk & Liability Waiver

Inherent Risks: The Client acknowledges that surfing involves inherent risks, including falls, contact with marine life, collisions with surfboards, contact with the ocean floor, and ocean currents.

Liability: To the maximum extent permitted by law, Surfing4all and its instructors shall not be held liable for personal injury, property loss, or damage resulting from the client’s failure to follow safety instructions or inherent sports risks.

Note for California Operations: Participants in San Diego may be required to sign a separate Liability Waiver and Release Form prior to entering the water, in compliance with California state laws.

Note for Minors: Participants under 18 years old must have a parent or legal guardian sign the agreement/waiver.

6. Media Release / Uso de Imagem

During surf sessions, our team may capture photos or videos for instruction and marketing.

Unless you explicitly opt-out in writing prior to your lesson via email to [insert email], you grant [Company Name] permission to use your image/video on our official website, social media channels, and promotional materials.

7. Governing Law and Jurisdiction

Due to our dual-location operations, governing law applies based on where the service is rendered:

For Lessons Rendered in San Diego, CA: These Terms are governed by and construed in accordance with the laws of the State of California, United States. Any legal disputes shall be resolved in the courts of San Diego County, California.

For Lessons Rendered in Rio de Janeiro, Brazil: These Terms are governed by the laws of the Federative Republic of Brazil (including the Código de Defesa do Consumidor). Any legal disputes shall be submitted to the courts of the Comarca do Rio de Janeiro, RJ.
